11. Transfer of undertakings

Where undertakings are transferred between employers the employment rights of the employees must be respected under the transfer of undertakings (protection of employment) regulations.

A new employer cannot pick and choose which employees to take on and thus cannot terminate contracts.

Broadly the new employer has the same responsibilities and obligations to his new employees as the old and the employees can continue to retain all their rights including their period of continued employment.
