11. Transfer of undertakings
Where undertakings are transferred between employers the employment rights of the employees must be respected under the transfer of undertakings (protection of employment) regulations.
A new employer cannot pick and choose which employees to take on and thus cannot terminate contracts.
Broadly the new employer has the same responsibilities and obligations to his new employees as the old and the employees can continue to retain all their rights including their period of continued employment.
While we hope the above has been found to be useful it is intended only as a general guide, may not reflect the very latest developments in law, and cannot be a substitute for professional advice. We cannot accept any responsibility for loss occasioned to any person acting or refraining from acting as a result of material contained in this guide
